Terms of Service

These Terms form a binding agreement between GymForce Technologies LLP (LLPIN ACB-9336) (“GymForce”) and the person or business accepting them. By accepting during onboarding or setup, or by using the Service, you confirm that you are at least 18, are authorized to bind the business you represent, and agree to these Terms, the Privacy Policy, the Refund & Cancellation Policy, and any applicable Data Processing Agreement. GymForce may record the acceptance time, policy version, flow, IP address, and browser information as electronic-contract evidence.

GymForce is a gym-management platform that provides:

• Member management and tracking
• Payment processing and billing
• Class scheduling and booking
• Staff management tools
• Analytics and reporting
• Mobile-app access

To use the Service, you must create an account and agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for activity under your account
• Notify us of unauthorized use

You may use the Service only for lawful purposes. You must not:

• Violate applicable laws or regulations
• Transmit harmful, threatening, or offensive content
• Attempt unauthorized access to our systems
• Interfere with or disrupt the Service
• Share account credentials without authorization
• Reverse engineer or attempt to extract source code

GymForce does not offer a generally available free trial. If a 7-day promotional trial is expressly granted, data entered during that trial is scheduled for automatic deletion when it expires unless a paid licence is purchased first, and it may not be recoverable.

GymForce is not presently registered for GST. Licence prices are therefore the software charges stated by us and are not represented as GST-inclusive or GST-exclusive. We will not collect GST or issue a GST tax invoice unless our registration or tax treatment changes.

Licence prices may increase. Unless a signed order fixes a price for a stated term, renewals, plan changes, add-ons, additional branches, and later purchases use the then-current price regardless of the original purchase price. A change will not retroactively alter a fully paid current term.

Refund eligibility is governed by the Refund & Cancellation Policy. Cancelling prevents future renewal but does not automatically create a refund.

The Service, its content, features, and functionality are owned by GymForce and protected by applicable intellectual-property laws.

• Do not copy, modify, or distribute our software
• Do not use GymForce trademarks without permission
• Do not create unauthorized derivative works
• Do not remove proprietary notices

Our collection and use of personal information is governed by the Privacy Policy, which is incorporated into these Terms by reference.

We work to provide a reliable service but cannot guarantee uninterrupted, error-free operation, complete protection from every threat, or compatibility with every device and browser. Maintenance or updates may temporarily affect availability, with reasonable notice where possible.

You may cancel through your account or by contacting GymForce. We may terminate access with notice, or immediately for a material breach of these Terms. When service ends, access may cease and data will be handled according to our retention obligations.

The Service is provided “as is” to the extent permitted by law. GymForce disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties regarding complete accuracy or reliability.

To the extent permitted by law, GymForce will not be liable for indirect, incidental, special, or consequential damages arising from use of the Service.

You agree to indemnify and hold GymForce harmless from claims, damages, or expenses arising from unlawful use of the Service or violation of these Terms.

These Terms are governed by the laws of India. Disputes will be handled by courts of competent jurisdiction in India, subject to applicable law.

We may update these Terms. Material changes will be communicated by email or through the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.

If any provision is found unenforceable, the remaining provisions will continue in full force and effect.
